PB-5 (declaration of the right to use the property)
The client's declaration that they hold a legal title to the property allowing construction work on it. A mandatory attachment to a permit application and to a notification.
The client lists the plots and the basis of their right: ownership, co-ownership, perpetual usufruct, lease, management or another contractual relationship. The declaration is made under criminal liability, so the basis stated has to match the actual situation rather than an intention.
With co-ownership the other co-owners' consent is needed, and this is where cases most often stall. For a married couple under joint ownership both usually sign, or one signs with the other's power of attorney.
An architect does not sign PB-5 on the client's behalf. They can prepare it and fill it from project data, but the signature belongs to the person holding the right, or to their attorney.
